Gag Clause Attestation Reminder!

 

This is a reminder that the attestation of compliance for employer-sponsored group health plans is due to the U.S. Centers for Medicare and Medicaid Services (CMS) by December 31, 2024.  This is an annual requirement with each attestation covering the period from the date the previous attestation was filed, through the current submission date.

Marsh McLennan Agency (MMA) published an updated guide addressing this prohibition on gag clauses in detail, including the mechanics of how to complete the attestation if it is necessary for an employer to do so.

Summary of 2025 Health & Welfare Plan Limits and Other Annual Adjustments

 

The Internal Revenue Service released Revenue Procedure 2024-40 on October 22, 2024, which contains the 2025 inflation adjustments for various employee benefit plans, including health care flexible spending accounts, qualified transportation fringe benefits, and adoption assistance programs. This alert also summarizes other health and welfare benefit plan limits announced earlier this year and provides a brief summary of changes to the employer shared responsibility penalties under the Affordable Care Act.
